The story continues in the first reported death caused in a DWI roadblock. Today's Eagle Tribune article by JJ Huggins chronicles the latest news in this horrific case that was spawned by a Thanksgiving Eve DWI roadblock in Massachusetts. Read about the blunt force trauma to the head, face and chest of this passenger who was killed in a DWI roadblock. The police can never prove that a single life has been saved in a DWI roadblock. Wouldn't it be helpful for this investigation if this incident had been videotaped? Police videotape arrests and roadblocks around the country, why not here? Because people seldom look or sound as drunk on a real video recording as they sound in a police report?

Do People Ever Get Arrested For No Good Reason?
Hello Everyone,
This video shows a Jets fan getting arrested at Qualcom stadium in San Diego at yesterday's playoff game, apparently for cheering for the Jets. He wasn't swearing, fighting or doing anything illegal at all. His crime seems to be chanting "Jets! Jets! Jets!" and pointing at his Jets shirt. Watch this disturbing video of a platoon of cops arresting him. Listen closely as the police discuss using a taser on the Jets fan.

Please don't play this with children watching as the audio picks up another fan using some obscenities while protesting the innocent man's arrest. I don't know what this man was charged with, but I would guess some combination of Disorderly Conduct, Resisting Arrest and maybe even an assault charge or two. This happens in many cases because there is no video. This will be an interesting story to follow.

Change You Can Believe In: A Common Sense Change to New Hampshire's "Certification as a Habitual Offender" Law
The Criminal Justice and Public Safety Committee of the New Hampshire House of Representatives will meet today on HB 1173, a bill titled, "An act relative to the requirement for certification as a habitual offender". This bill is sponsored By Representative Keans. I will be testifying in favor of the passage of this bill on behalf of the New Hampshire Association of Criminal Defense Lawyers. This bill seeks to make a common-sense change to the current version of New Hampshire's :certification as a habitual offender" law, which currently treats a violation level conviction for "operating after suspension" the same as a DWI, leaving the scene of an accident, reckless driving, and other "major offenses". The underlying suspensions for an "operating after suspension" charge in New Hampshire under RSA 263:64, though, can be for something as minor as failing to pay a ticket or fee.
It is important to note that this bill would not change the treatment of any convictions for driving after a DWI suspension, as those are covered under a separate statute. Please let your state representative know that this bill makes sense to you and encourage its passage in the house of representatives.
