Here's food for thought. What if the cops said your breath test result was higher than a .10 but you were sober. Doesn't matter any more, right, because you'd be "over the legal limit", meaning a breath test allegedly higher than a .08. But what if the cop exaggerated your breath test result, all the way up from a .06 to over a .10? Surely no cop would do that would they? Read this infuriating case from Vermont where that's exactly what happened:
http://www.burlingtonfreepress.com/article/20100219/NEWS02/100218040
To top it off, the state is still clinging to the notion that they have the right to do exactly what this trooper did! Despite losing a lawsuit for this driver's damages, the state's lawyer argues that the trooper was "out there trying to do his job".
So why do innocent people refuse to blow into these gadgets again? Yet another dark tale of a sober person whose "result" was higher than .08.
Have a safe night,
Mark Stevens

Man Arrested for DWI Dies Horrific Death in Custody in Georgia
Warning: this jail surveillance video may be disturbing. A man arrested for DWI in Georgia was taken in custody and placed in a county jail where he died. As you will see in the story from Atlanta's CBS affiliate below, this video is disturbing. This man was restrained in a chair for 14 hours while he was suffering from DTs and he died. It is also shocking that the same sheriff's office tried to serve a warrant on the man for failing to appear in court after he had died in custody.

Note the level of concern from the sheriff during this interview about this man's agonizing death in his jail.

When Asked By a Cop to Rate Yourself On a Scale of Zero to Ten, Be A Zero
If you are arrested for DWI in New Hampshire, the arresting officer may ask you to rate yourself. The trick question goes along these lines: "So on a scale of zero to ten, with zero being stone cold sober and 10 being falling down drunk, where would you rate yourself." The cop is not going to factor your answer into his arrest decision. He has already decided to arrest you he just hasn't shared that bad news with you yet.
The cop is asking you this question so that you will incriminate yourself. If you cannot remain silent, as you should, answer "ZERO" and say no more. I posted a new video on YouTube regarding answering "zero", called: "Be A Zero": Here it is:
