Prosecution Sends Innocent Man to Prison Due to DNA Screwup by State: Don't Worry Though, Sheriff Says the DNA mix up was ‘unacceptable’

Here's the latest crime lab screw up that caused an innocent man to go to prison for a crime he didn't commit, this time based on a "mistake" with DNA, the prosecution's "gold standard" of forensic "science". DNA evidence is hawked in courts by prosecutors as being statistically flawless, ruling out the entire rest of the world as potential suspects, except the person sitting in the defendant's chair. So what could go wrong? It sounds so perfect? Well in this case the prosecution used the wrong DNA to throttle a man into pleading guilty to something he didn't do, then packed him off to the Nevada state prison for four years. More DWI Lawyer Advertising Warnings

Hello every one. I hope every one is having a safe and happy Independence Day. From time to time I alert you to some scuzzy advertising practices. In the past I have posted about the direct junk mail campaigns of some lawyers who mail unsolicited advertisements to people who have just been arrested. As you can imagine, it's not the cream of the crop doing this.

A new tactic I have noticed is that some lawyers will use my name in anchor text but when you click on the text you will get directed to the other lawyer's website. Googling "Attorney Mark Stevens" will reveal some of these. "Anchor text", or "link text" is the visible, clickable text in a hyperlink. The words contained in the anchor text can determine the ranking that the page will receive by search engines.

So the reason that other lawyers would do this is because I rank organically higher than them. If you see a lawyer in the three shaded boxes at the top of a google search, or on the right hand column in a line of little boxes, they are paying for the spot. If you look at the ten spots below the shaded entries, these are pages that rank highly "organically", or because of their content.

I appreciate every one who searches for me on google. I appreciate that my clients are smart enough to know when they are on my web site or some one else's. Don't be duped. Accept no substitutes. Have a great weekend.

If you get stopped and the police suspect you are intoxicated ("DUI/DWI")they will ask you about drinking. "Have you been drinking?" is the tricky way the question is posed. You may have had a beer or two. But the way the question is posed, an affirmative answer sounds like you've been sitting around a bar in a drinking contest.

If you answer "yes" and describe what you drank, you will be well on your way to getting arrested and prosecuted. Once the cop asks, he is probably considering arresting you no matter what you answer.

There is no better time to exercise your right to zip it and your right to a lawyer than when a cop asks you if you have been drinking. Most innocent people beleieve that if they explain to the police what they drank that they are helping themselves. Wrong! Be careful how you answer any question posed by the police when you are stopped.

Underage Drinking Charges in New Hampshire: "Minor In Possession" Cahrges

"Minor in Possession" of alcohol laws in New Hampshire. If you have been charged or accused of "minor in possession of alcohol", "underage drinking" "unlawful intoxication" or any other charges under New Hampshire's tough "unlawful intoxication" statute, RSA 179:10, the potential consequences are serious, including a drivers license revocation if you are found guilty in Court. Here is the current state of New Hampshire’s “minor in possession of alcohol” and “unlawful intoxication by a minor” law:

RSA 179:10 (2011)

179:10 Unlawful Possession and Intoxication.

I. Except as provided in RSA 179:23, any person under the age of 21 years who has in his or her possession any liquor or alcoholic beverage, or who is intoxicated by consumption of an alcoholic beverage, shall be guilty of a violation and shall be fined a minimum of $300. Any second and subsequent offense shall be fined at least $600. For purposes of this section, alcohol concentration as defined in RSA 259:3-b of .02 or more shall be prima facie evidence of intoxication. No portion of this mandatory minimum fine shall be waived, continued for sentencing, or suspended by the court. In addition to the penalties provided in this section, the court may, in its discretion, impose further penalties authorized by RSA 263:56-b.

II. Except for persons convicted on the basis of intoxication, any person under the age of 21 years convicted of unlawful possession of liquor or beverage shall forfeit the same, and it shall be disposed of as the court directs. The proceeds, if any, shall be paid into the treasury of the county in which the proceedings were determined.
