 Under New Hampshire’s wierd aggravated DWI law there is “guilt by cooperation”, meaning that if you cooperate and blow into the breath test machine when the officer requests it, you can end up in jail.


 


Another motor vehicle law to watch out for is New Hampshire's reckless driving or "reckless operation" law.  Here is a text of the law:

  Here is New Hampshire's 2011 version of its Reckless Driving Law:

RSA 265:79 (2011)

265:79 Reckless Driving; Minimum Penalty.

Whoever upon any way drives a vehicle recklessly, or causes a vehicle to be driven recklessly, as defined in RSA 626:2, II(c), or so that the lives or safety of the public shall be endangered, or upon a bet, wager, or race, or who drives a vehicle for the purpose of making a record, and thereby violates any of the provisions of this title or any rules adopted by the director, shall be, notwithstanding the provisions of title LXII, guilty of a violation and fined not less than $500 for the first offense and $750 for the second offense nor more than $1,000 and his or her license shall be revoked for a period of 60 days for the first offense and from 60 days to one year for the second offense.

OUI CLE Course Today: OUI Drug Impairment Cases

New Hampshire DWI Law and Massachusetts OUI Laws. Today's MCLE program on Maassachusetts OUI cases in Plymouth, Massachusetts will focus on OUI charges alleging drug impairment.  There will be a DRE presentation and cross examination topics, as well as a Massachusetts case law update and trial tips and techniques involving "DRE evaluations" and "drug impairment".  I will be on the faculty panel throughout the day.  My topics will be horizontal gaze nystagmus ("HGN") and vertical gaze nystagmus ("VGN") testing as well as the components of the Drug Recognition Expert ("DRE") evaluation, as well as legal issues that arise in these cases. 

This course will be held at the John Carver Inn, 25 Summer Street, Plymouth, Massachusetts today, December 6, 2011 from 1:30 p.m. to 5:30 p.m.  I hope to meet you there.  Please feel free to bring along narrative reports from your cases with you for discussions and questions.
This will be a great OUI seminar, OUI laws update, and will include a lot of relevant OUI materials.

New Hampshire DWI Laws Continuing Legal Education Course December 2, 2011

New Hampshire DWI Law.  The 2011 annual New Hampshire Bar Association DWI seminar is being held tomorrow, December 2ndat the New Hampshire Bar Association in Concord, New Hampshire.  I am on the faculty panel and my topics will be pre-trial discovery in DWI cases and cross-examination practice.  I am also on the panel discussion group for NH DMV hearing portion of the course.  A link to the course information is here: Anatomy of a New Hampshire DWI Case . This will be a great all-day seminar addressing administrative license suspension hearings, New Hampshire DWI laws, search and seizure issues and other relevant DWI topics.  The course begins at 8:30 a.m.  I hope to see you there tomorrow in Concord.
