Be a Zero: Rating Yourself on a Scale of Zero to Ten

Hello everyone. In my last post I talked about our Fifth Amendment right to be free from compelled self-incrimination during police interrogations about drinking or drug impairment. Today's topic involves a trick question used by police just prior to arresting a driver for DWI. It is important to note that the driver who is asked this question is about to be arrested for DWI no matter what he or she says.

The trick question is usually presented to the anxious driver after the officer finishes with "field sobriety tests", the sidewalk ritual in which the driver performs like a circus monkey. The trick question goes like this:

"On a scale of zero to 10, with zero being sober and 10 being falling down drunk, where would you put yourself?"

This is a great time to exercise your right to remain silent and your right to ask for a lawyer before further questioning. In all likelihood, you are about to be arrested right after you answer this question, and 10 out of the 11 possible answers are incriminating.

ANSWERING THIS QUESTION AT ALL CAN LEAD TO YOUR CONVICTION FOR DWI WHETHER YOU ARE DRUNK OR NOT!

Like any other question posed by the officer during the roadside interrogation, you do not have to answer this question. Your answer cannot help you. You do not have to answer this question. It is designed to trick you and eventually convict you.

ANSWERING "ZERO" OR NOT ANSWERING THE QUESTION AT ALL ARE PROBABLY THE SAFEST AVENUES FOR YOU.

People are being convicted simply because they answer this tricky question. Think about how you would answer this question ahead of time. The police officer has already thought of the questions he is going to ask a driver to attempt to gather incriminating statements. You should think about how you might answer this question ahead of time, before you ever have to answer it under pressure.
