New Case Victories Posted

Hello everyone. There are two new case victories posted on my web site:

As you'll see, one was a victory in a DWI case alleging a .15 blood result and the other was a minor in possession of alcohol case in which the defendant was smart enough not to blow into the hand-held battery-operated breath gizmo when asked to by police.

  1. CAN YOU REFUSE TO BLOW INTO THESE THINGS?HOW CAN COPS ASK YOU TO BLOW INTO IT WITHOUT TELLING YOU THAT YOU DONT HAVE TO?

  2. Hello. Your question has two questions contained within it. Ill try to answer both. 1. NO, you cannot be forced to blow into a roadside breath testing box. 2. The statute on PBT breath testing boxes requires that you be told of the consequences for blowing into the box, and that there are no penalties for refusing at roadside. It is important to note that this is diferent than an implied consent refusal to give blood or blow into the larger box at the police station. See my website for copies of both of these laws:
