New Hampshire Laws: Major Penalties Added for Passing A School Bus in 2016

New Hampshire Law on Passing a School Bus: Penalties Cranked Up in 2016. Some major changes were made to the New Hampshire law on passing a school bus that severely increased the punishment for convictions, titled "Buses" (RSA 265:54),  which went into into effect on January 1, 2016 in New Hampshire.  Here is the law:

Buses

Section 265:54

265:54 Overtaking and Passing School Bus. –
    I. The driver of a vehicle upon a way upon meeting or overtaking from either direction any school bus, plainly marked with school bus signs or such other distinguishing identification as the director may require, which has stopped on the highway for the purpose of receiving or discharging school children shall stop his or her vehicle before reaching such school bus at least 25 feet away from such school bus. The driver shall not proceed until such school bus resumes motion, or until flashing red lights cease to operate.
I-a. Testimony under oath from the school bus driver or other witness that a vehicle failed to stop and remain stopped as required by paragraph I shall be sufficient evidence to prove that the owner of the vehicle was driving and has violated the provisions of paragraph I, unless such evidence is rebutted or contradicted.
I-b. Except as provided in paragraph IV, a person who violates the provisions of paragraph I shall be guilty of a violation and shall be fined $150 plus penalty assessment for a first offense, and shall be fined not less than $250 nor more than $1,000 for a subsequent offense. In addition, the director may suspend the person's license to drive or nonresident driving privilege for a period of 30 days for a second or subsequent offense.
II. Whenever road conditions and space permit and whenever the number of vehicles following a moving school bus is 5 or more, the driver of the school bus shall pull over and let the following vehicles pass. A driver passing the school bus must do so without driving any part of his vehicle to the left of or across any unbroken painted line marked on the highway.
III. The driver of a vehicle upon a divided highway with separate roadways need not stop when meeting or passing a school bus which is traveling in the opposite direction on the other half of the divided highway, or when upon a controlled access highway if a school bus is stopped in a loading zone which is part of or adjacent to such highway and pedestrians are not permitted to cross the roadway.
IV. Except as provided in paragraph III, no driver of a vehicle who is required to stop his or her vehicle in accordance with paragraph I shall overtake and pass a school bus on the right. A person who violates the provisions of this paragraph shall be guilty of a violation and shall be fined $500 plus penalty assessment. In addition, the director shall suspend the person's license to drive or nonresident driving privilege for a period of up to 30 days for a first offense. For a second or subsequent offense, the person must appear before the court and shall be fined not less than $500 nor more than $1,200 plus penalty assessment. The director shall suspend the person's license to drive or nonresident driving privilege for a period of 30 days for a second offense, and for a period of not less than 30 days nor more than 120 days for a third or subsequent offense.

Some thoughts on this law:   Be careful while driving. Do not pass a school bus at times under conditions prohibited by this law.  The safest thing to do is to pay attention to the road.  However, if you get stopped and the police question you about whether you illegally passed a school bus, it is as unwise to admit to that as it is to admit to any other other crime or motor vehicle violation. Call me at 1-603-893-0074 to discuss your situation if you would like to do so.

Conflicting Provisions: Paragraphs I-b and IV are in conflict with each other regarding penalties for a conviction.

Potentially Unconstitutional Definition of "Sufficient Proof" of Guilt:  Paragraph I (a) of this law may be constitutionally challenged as it contains a presumption of guilt if "testimony under oath from the school bus driver or other witness that a vehicle failed to stop and remain stopped as required by paragraph I shall be sufficient evidence to prove that the owner of the vehicle was driving and has violated the provisions of paragraph I".  1.  The burden of proof in any criminal or motor vehicle trial is squarely upon the state, not the accused.  2. "Sufficient evidence" does not equal "proof beyond a reasonable doubt".  3. The fact that a "vehicle" allegedly violated this law does not logically prove that the "owner" was driving it at the time.  4.  The law does not give any judicial discretion to either credit the witnesses' testimony, discredit it, or credit in in part.  All the witness has to do is testify under oath, no matter how credibly or incredibly, to sustain a conviction.

This law creates other encroachments upon the Constitutional rights of the accused, another of which is the law's legal standard that the accused will be convicted if the bus driver or any other witness claims the driver passed the bus, "unless such evidence is rebutted or contradicted." The accused in the United States does not bear any burden of proving her innocence.  This law seems to carve out an exception to that guarantee.

If you have been charged with passing a school bus in New Hampshire you are now facing serious consequences for a first offense, even if your record is spotless and even if you did not even illegally pass the bus.  Feel free to call me right away at 1-603-893-0074 if you have been charged or are under investigation for passing a school bus.

New Hampshire Laws: "Possession of Drugs" When the Cops Find Them in Your Car

New Hampshire Drug Laws . Most people in New Hampshire know that marijuana is still illegal.  It's crazy but true.  If you're stopped by the police, and you've got a stem or some resin in a pipe in your car, you will likely be arrested and charged with the crime of "Possession of Drugs" under New Hampshire's Motor Vehicle Code RSA 265-A:43.  That law reads like this:

TITLE XXI  Motor Vehicles
CHAPTER 265  Rules of the Road - Serious Traffic Offenses
RSA 265-A:43 Possession of Drugs  (2013)

265-A:43  Possession of Drugs.
Any person who drives on any way a vehicle while knowingly having in his possession or in any part of the vehicle a controlled drug or a controlled drug analog in violation of the provisions of RSA 318-B shall be guilty of a misdemeanor, and his or her license shall be revoked or his or her right to drive denied for a period of 60 days and at the discretion of the court for a period not to exceed 2 years.

That's a harsh law.  It is also now considered a major motor vehicle offense for the purposes of "habitual offender" certification, which can cause you other licensing problems down the road.

Happy 4-20 from Salem, NH DWI Criminal Defense Lawyer Mark Stevens1-603-893-0074

If the Police think you're buzzed from marijuana, controlled substances, and yes, even over the counter medications (including cough syrup) you can be charged with a DWI in the state of New Hampshire. New Hampshire's DWI penalties and consequences are relentlessly unforgiving.

These harsh legal penalties can haunt citizens busted for driving under the alleged influence of weed just as long as a drunk driving charge. Don't put yourself (or your reputation) in the hot seat if the cops want to stop and ask you questions,  take Attorney Mark Stevens advice: Lawyer Up and Shut Up. You Don't Have to Talk to the Cops!

3 Times you shouldn't say "YES" to the cops:

  1. Is there anything in the car I should know about?
  • (not good to say “yes” if the answer is “weed”)
  1. Have you been smoking weed?
  • (“yes” being an obvious bad answer)
  1. Do you feel buzzed?
  • (“buzzed” = “guilty” at a DWI trial)

If the cops suspect you of driving after you smoked marijuana, you will probably get arrested for DUI.  Don't wait call Mark Stevens (24/7)&@ 603.893.0074. & The consultation is free.

Prepare to Be Hassled This Sunday Night By the Cops

New Hampshire DWI attorney . It's Super Bowl Weekend!  If you are driving after the Super Bowl, the police will be watching you closely, looking for any reason to stop and hassle you to see if you are DWI or if you have a little weed in your car. In New Hampshire, the police patrol the roads and highways aggressively after the Super Bowl; if you have a light out, an inspection sticker expired or you license is suspended, the cops are likely to stop you and hassle you and your passengers.

Also, remember the absurd changes that were made in January 2013 to New Hampshire's DWI laws.  Unhappy with the amount of drivers already arrested for drunk driving and driving under the influence of controlled drugs, the New Hampshire legislators have  expanded New Hampshire's DWI law to include driving "under the influence" of "any over the counter drug, or any other chemical, natural or synthetic, which impairs a person's ability to drive".  You can now be prosecuted for driving under the influence of cough syrup or aspirin.

If you get stopped, you have to give him your license and registration and identify yourself.  Beyond that, the new DWI laws make it more important than ever not to answer a single question a cop asks you after you are stopped.  It may not be wise for you to answer any of a cop's questions about medications. If he is asking you about medications he is already deciding to arrest you; he is getting you to admit to prescription medication use. or now even cough syrup or allergy medicines: any statement has the potential to get you arrested for DWI in New Hampshire now! If they don't know what you have taken don't tell them!  You have the right to a lawyer and the right to remain silent when the police try to question you about anything. Here is an informational video with some hints:

Yet Another Cheating State Lab Tech Exposed & Arrested

New Hampshire Drug Laws. Massachusetts Drug Laws.  Here we go again.  Another state lab employee in the Massachusetts state crime lab has been arrested.  If this still shocks any one, it probably shouldn't. Sonja Farak, another crooked lab employee with the ability to send innocent people to prison, was arrested for falsifying drug test records that could send innocent people to jail.

Mass. officials under fire for second chemist arrest - Boston News, Weather, Sports | FOX 25 | MyFoxBoston

Don't worry though! The government says this shouldn't affect any other cases.  If you turn back the clock and watch some videos regarding the Annie Dookhan drug lab scandal, that's what they said then too.  "Trust us" they say, we're looking into it.  You should choose carefully whether you submit to any search for any reason.  Particular caution should be exercised when you consider submitting to a blood test to determine whether you are under the influence of alcohol or drugs, or to a search of your person, home or car that might reveal anything the police find suspicious.  Two of the people who were conducting these tests up until a few weeks ago have been caught cheating to win.  Think twice before you put your fate in their hands!

The best course of action is usually to lawyer up and shut up.  Here is a video with some suggestions on what to do if you receive some unwelcome mail from the state crime lab:

Tonight's Changes to New Hampshire DWI Laws: More Important Than Ever Not to Answer Cop Questions

New Hampshire DWI laws . Happy New Years every one. Please celebrate responsibly.

Effective tonight after midnight, some horrible changes take effect to New Hampshire's DWI laws.  Unhappy with the amount of drivers arrested for driving under the influence of alcohol and controlled drugs, the lawmakers have broadly expanded New Hampshire's DWI law to include driving "under the influence" of "any over the counter drug, or any other chemical, natural or synthetic, which impairs a person's ability to drive".  You can now be prosecuted for driving under the influence of spinach.

This makes it more important than ever not to answer a single question a cop asks you if you are stopped.  It may be unwise for you to answer any of a cop's questions about medications. If he is asking you about medications he has probably already decided to arrest you; he is getting you to admit to prescription medication use. If they don't know what you have taken don't tell them!  You have the right to a lawyer and the right to remain silent when the police try to question you about anything. Do You Have An Arraignment in a New Hamphire District Court Coming Up?

New Hampshire DWI Lawyer. Do you have an arraignment coming up for a criminal charge in a New Hampshire court?  This is an important step in New Hampshire criminal case procedure.  It is also a step at which a lot of people make mistakes because they do not have a New Hampshire criminal defense lawyer yet.  When you arrive at Court, there will be a roll call to see if every one who has an arraignment is present.  Some times the clerk will ask you "how are you going to plead?".  And you may have no idea what you should do, what the options are, or what the consequences of your actions will be.  This is a scary process.

As this video explains, the best answer is to plead "not guilty" until you can consult with a New Hampshire criminal defense lawyer.

There are a huge number of arraignments scheduled for December 31st this year in New Hampshire courts.  This is in part because there are usually a high number of arrests between Thanksgiving and New Year's Day.  It is also in part due to changes the New Hampshire legislature has made to New Hampshire DWI laws, which require rapid procedural program requirements for New Hampshire DWI convictions.  The lawmakers have made it harder than ever for you to get your license back due to the number of time consuming hoops you will have to jump through if you are convicted of DWI.  So be careful when you are asked how you are going to plead.  There are an unusually large number of arraignments scheduled for the 10 Circuit Court in Salem (formerly known as "The Salem District Court").

A CALL TO ACTION:

Don't be a victim of this process because you are scared!  Call me right now before your arraignment at 1.603.893.0074 Call 24/7.  Feel free to program my number into your cell phone right now in case you need it later.  If you are unsure how to plead at your arraignment don't plead guilty until you have had a chance to speak with me.

I look forward to speaking with you and trying to help you have a Happy New Year!

Big Changes to NH DWI Effective New Years Eve: Its More Important Than Ever To Lawyer Up & Shut Up

NH DWI Laws. The holidays are a busy time of the year and most people are not thinking about DWI checkpoints or police saturation patrols especially those out celebrating and enjoying the seasons' festivities with their loved ones and family.

The NH Police announced their statewide efforts to once again crack down on drunk drivers and those not obeying the laws from the Maine state line to the Massachusetts border on December 14th and early December 15th. They also announced that their tactics this weekend would be much different than their typical DWI checkpoints. They will not have designated 'checkpoint' areas for stopping  drivers.   Local and state police will be out and heavily patrolling:  I-95, Routes 101, and  Route 286 and 1A specifically monitoring ALL drivers on the roads Friday night and early Saturday morning.

If you live around the NH Seacoast- or simply plan on being 'out and about' in Portsmouth, Exeter, Rochester, Hampton Beach, Seabrook, or Brentwood areas (December 14 and 15th) the cops are looking for people to pull over and they don't need a sobriety checkpoint to do it this weekend!

Call to Action:

If you get hassled this weekend and the cops want to ask you questions, remember Lawyer Up & Shut up- then call DWI & Criminal Defense Attorney Mark Stevens at  1.603.893.0074   (24/7)    If you have problems with the cops, call Mark Stevens. He'll know what to do. Check out Attorney Stevens' winning case examples and find out more information by visiting us at ByeByeDWI.com. We look forward to speaking with you.
