The Massachusetts Supreme Judicial Court issued an important decision that effects the rights of people accused or convicted of first degree murder, where the murder occurred before the defendant was 18 years old.  In Diatchenko v. District Attorney, SJC Case Number 11453, issued December 24, 2013, the Court addressed the effect of the United States Supreme Court decision in Miller v. Alabama, 132 S. Ct. 2455 (2012), which held that the imposition of a sentence of life without possibility of parole on a defendant under age 18 at the time they committed the murder violated the Eighth Amendment's cruel and unusual punishment clause.

Thirty years ago, Diatchenko had been tried and convicted for a stabbing murder in Kenmore square when he was seventeen.  His conviction was affirmed in Commonwealth v. Diatchenko, 387 Mass. 718, 719 (1982). Today the Massachusetts SJC ruled that Miller applies retroactively, and that the imposition of a sentence of life without parole on a defendant under the age of 18 violates Article 26 of the Massachusetts Declaration of Rights.

Massachusetts Supreme Judicial Court Limits Cops' Guess-Timony on Driver's Ability to Operate in OUI Cases

In a decision important to OUI trials in Massachusetts state courts, the Massachusetts Supreme Judicial Court issued an opinion on Thursday that prohibits cops from testifying that a defendant's "ability to safely operate a motor vehicle was diminished by his or her consumption of alcohol".   This had been, until Thursday's ruling, a common end to the arresting cop's direct testimony.  This police officer opinion has routinely been parroted at the end of the officer's testimony in response to a leading question by the prosecutor, usually it went something like this:

PROSECUTOR:  "Based on all your observations with the driver, including (the prosecutor then drones about everything the cop has testified about already), were you able to form an opinion that the driver's ability to safely operate a motor vehicle had been diminished by alcohol?"

COP: "Yes."

PROSECUTOR:  "And what was that opinion?"

COP: "Based on (cop then regurgitates all the observations the prosecutor just named) I formed the opinion that the driver's ability to safely operate a motor vehicle had been diminished by alcohol consumption".
    
This rote question and answer series was prohibited Thursday by the Supreme Judicial Court in the case of Commonwealth v.  Canty, SJC Case No. 11315 (November 6, 2013).  While a cop, or any other witness, can give an opinion that a driver, or any other person, was drunk or intoxicated, a witness cannot express an opinion as to whether a defendant is guilty or innocent.  Where the ultimate issue in an OUI trial is for the trier of fact to determine whether a driver's ability to operate a motor vehicle has been diminished by alcohol, this opinion by the cop was inappropriate.

Prepare to Be Hassled This Sunday Night By the Cops

Crooked Lab Chemist Busted!

On August 30, 2012, a State Lab in Massachusetts was ordered to be shut down by MA Governor Deval Patrick.  Nearly a month later, an arrest has finally been made.  State police arrested thirty-four-year-old Annie Dookhan of Franklin, Massachusetts, at her home today.  She has been accused of obstruction of justice and pretending to hold a master’s degree in chemistry from the University of Massachusetts.  According to an article published by CNN, “The former chemist has admitted to wrongdoing during her nine-year employment with the Department of Public Health.”  However, Massachusetts officials are left with the sentences of 1,140 people of whom are currently serving time in prison.  Due to the criminal evidence under investigation provided by, or at least partly provided by Dookhan at the time of conviction an approximate figure of around 30,000 drug cases are now under review.  In addition, according to a preliminary investigation Dookhan may have handled 60,000 samples involving drug cases and convictions in the state of Massachusetts from 2003-March 2012.

*DWI Roadblocks: Checkpoints this Weekend, Portsmouth & Seacoast Communities*

The pinnacle of  summer is here and seems to be sizzling up some "heat" in NH's Seacoast Communities. The NH State Police Troop A  with cooperation of the Portsmouth Police Department have announced TWO DWI Checkpoints over the course of the next week. According to recent numbers, the amount of alcohol related incidents resulting in fatalities and personal injury accidents is what prompted the NH State Police and Portsmouth Police Department to apply and receive approval from a Superior Court Petition to conduct these Sobriety Checkpoints. The NH Highway Safety Agency and National Highway Traffic Safety Administration (whom provide federal highway safety funds) approved the Sobriety Checkpoints to be conducted during the week of AUGUST 13th - AUGUST 19th  in Portsmouth and surrounding areas.  An article published by the Portsmouth Patch stated: "NH State Police Troop A Commander Lieutenant Gary Wood and Chief David Ferland of the Portsmouth Police Department have taken an aggressive stance to prevent persons from driving when intoxicated. New Hampshire has some of the most aggressive laws in the country to fight the intoxicated driver and the law enforcement community will use those tools to their full extent."

The following is from the National Highway Traffic Safety Administration ("NHTSA")'s manual used in police training titled "DWI Detection and Standardized Field Sobriety Testing" (February 2006 Edition):

Procedures for Walk and Turn Testing:

1. Instructions Stage: Initial Position and Verbal Instructions

For standardization in the performance of this test, have the suspect assume the heel-toe stance by giving the following verbal instructions, accompanied by demonstrations:

o "Place your left foot on the line" (real or imaginary). Demonstrate.
o "Place your right foot on the line ahead of the left foot, with heel of right foot against toe of left foot." Demonstrate.
o "Place your arms down by your sides." Demonstrate.
o "Maintain this position until I have completed the instructions. Do not start to walk until told to do so."
o "Do you understand the instructions so far?"

2.  Demonstrations and Instructions for the Walking Stage

Explain the test requirements using the following verbal instructions, accompanied by demonstrations:

o "When I tell you to start, take nine heel-to-toe steps, turn, and take nine heel-to-toe steps back." (Demonstrate 3 heel-to-toe steps).
o "When you turn, keep the front foot on the line, and turn by taking a series of small steps with the other foot, like this." (Demonstrate).
o "While you are walking, keep your arms at your sides, watch your feet at all times, and count your steps out loud".
o "Once you start walking, don't stop until you have completed the test."
o "Do you understand the instructions?" (Make sure suspect understands.)
o "Begin, and count your first step from the heel-to-toe position as "One".

3. Test Interpretation

You may observe a number of different behaviors when a suspect performs this test...Look for the following clues each time the One Leg Stand test is administered:

A. Cannot keep balance while listening to the instructions.
B. Starts before the instructions are finished..
C. Stops while walking.
D. Does not touch heel-to-toe.
E. Steps off the line.
F. Does not touch heel-to-toe.
G. Uses arms for balance.
H. Improper turn.
I. Incorrect number of steps.

If the officer thinks you did two of these eight things wrong, however slightly, you lose. 6 out of 8 on this test, a 75% or "C" on any sort of objective test, is a failure at the roadside and you get arrested. If you can't get an "A" on this you'll be arrested.

What about the fact that you'll be doing this exercise on ice if you do it in New Hampshire this weekend? It doesn't matter according to the folks at the government who cobble these manuals together. In the same NHTSA manual, at page VIII-11 pronounces the following:

"Test Conditions"

Walk-and-Turn test requires a designated straight line, and should be conducted on a reasonably dry, hard, level, non-slippery surface. There should be sufficient room for suspects to complete nine heel-to-toe steps. Note: Recent field validation studies have indicated that varying environmental conditions have not affected a suspect's ability to perform this test"

• Another thing to watch out for just before any "test" starts is a request by the police to "check your eyes." This sounds pretty innocuous, but it is really just a way to get you to comply with the "testing" that you cannot be forced to do. Logically, why would you want a cop to give you an eye exam in the dark? REMEMBER: YOU CANNOT BE FORCED TO SUBMIT TO THE PEN TEST OR ANY OTHER "FIELD SOBRIETY TESTS" AT THE ROADSIDE!!!!  The police will often say that they would like you to step out of your car "to check and see if you are okay to drive". Once you are asked to step out of your car the chances of you stepping back into it are slim. Think twice before you give the police any evidence to use against you!
• PREPARATION FOR THE WORST CASE SCENARIO: Try this absurd test on your own at home and see if you can ever pass it. It may help you make a more informed decision when the cops ask you to do it at the roadside, especially in the wintertime. If you are asked to do it, it is highly likely that the officer has already decided to arrest you, and he is now in the evidence gathering stage. Choose whether to incriminate yourself very carefully.

"Motorists are forewarned that we will make every effort to apprehend drunk drivers and ask that patrons of bars and restaurants in the Seacoast make the right choice: use designated drivers, cabs or call a friend; when you drink and drive you risk your life and put others lives in danger," advised Portsmouth Police Capt. Mike Schwartz in a follow up article released by the Portsmouth Patch regarding the Sobriety Checkpoints  this upcoming week and weekend.

Here is New Hampshire's DWI law, which defines the elements of the crime of driving while intoxicated that the state must prove beyond a reasonable doubt:

RSA 265-A:2-Driving While Intoxicated RSA 265-A:2  (2012) 265-A:2  Driving or Operating Under Influence of Drugs or Liquor; Driving or Operating With Excess Alcohol Concentration.    I.No person shall drive or attempt to drive a vehicle upon any way or operate or attempt to operate an OHRV:   (a) While such person is under the influence of intoxicating liquor or any controlled drug or any combination of intoxicating liquor and controlled drugs; or   (b) While such person has an alcohol concentration of 0.08 or more or in the case of a person under the age of 21,0.02 or more. II. No person shall operate or attempt to operate a boat while under the influence of intoxicating liquor or a controlled drug or any combination of intoxicating liquor and a controlled drug or drugs, or while such person has an alcohol concentration of 0.08 or more orin the case of persons under the age of 21, 0.02 or more.

New Hampshire DWI Laws.   Beware New Hampshire drivers! Beginning today, May 25th and ending at Midnight on Monday May 28th, the Massachusetts and New Hampshire State Police plan on super-saturating all major state roads and highways.  The state police will spread their reach from NH - MA state borders to MA - ME state lines. They are looking to make DWI arrests and drug possession arrests all over New Hampshire and Massachusetts. The police will be swarming in marked and unmarked vehicles and even using airplanes to slow you down.  This is also traditionally a big weekend for police "DWI roadblocks" in New Hampshire, and crackdowns on texting and driving are expected.  

Extra high visibility patrols will be on I-93 from I-495 in Massachusetts to the Hooksett Toll Booth Plaza in NH and on I-95 in MA up through the ME state border as well. The Department of Transportation is amping up courtesy patrol units on I-93 between Exit 4 and the MA state line with numerous DWI and speeding detail units patrolling the roads all weekend. Extra troopers have been employed especially in Hampton Beach using every extra motorcycle patrol unit available to assist the Hampton Police. In Northeastern Massachusetts, MA State Troopers will be conducting sobriety checkpoints 1 of 3 days this weekend as part of the "Click it or Ticket" Operations initiative, as well as, "multiple saturation patrols," according to Maj. Edward Amodes of the MSP.
